经济法法典化:从“综合法”走向“整合法”

Codification of Economic Laws:From Comprehensiveness to Integration

我国经济法学界一直致力于以法典化的方式来提高经济法立法和经济法制度的体系化程度。在我国经济法立法形式上已较为完备,内容上却较为"综合"与"分散"的背景下,经济法法典化是提高经济法立法质量、优化经济法体系的重要路径和理性选择。经济法法典化以现行立法为基础,但立法的"问题导向"决定了单行法中的法律规范往往具有多重属性,因而是一种典型的"综合法",而法典编纂必须坚持"理论导向",所以,经济法法典化不是现行立法的简单合并,而是需要通过"立法整合"来对现行立法进行梳理,实现从"综合法"到"整合法"的实质性转变。经济法法典化中的"立法整合",需要在内外两个层面展开:"外部整合"主要是处理经济法规范与其他法规范的关系,并实现经济法制度与相关法制度的配合;"内部整合"主要是增进经济法理论对经济法制度的统领性,并增强不同经济法制度之间的协调程度。"立法整合"不仅是经济法法典化的基本路径,也是经济法面对"法的整合时代"的有效回应。

China's economic law academia has been committed to improving the systematic level of legislation and system of economic law by means of codification.At present,there is a large number of eco-nomic laws,and their contents are relatively comprehensive as well as decentralized.In this case,making a codifed economic law is an important path and rational choice to improve the quality of economic law legis-lation and optimize the economic law system.The codification is based on all current legilations,but the leg-islation has the characteristic of practice-oriented,which determines that the legal norms in legislation often have muliple atrbutes,so it is a typical“comprehensive law”.The codification must be theory-oriented,so economic law codification is not to merge the current legislations,but to sort out the legislations through“in-tegration”,so as to transform so-called“comprehensive law”to“integrated law”.Legislative integration needs to be carried out in two aspects:“external integration”is mainly to deal with the relationship between economic law and other laws,so that they can cooperate with each other;“internal integration”is mainly to enhance the relationship between theory and system in economic law,and enhance the coordination between different economic law systems.Legislative integration is not only the basic path of codification,but also the response of economic law to the“era of law integration”
