网络空间法学研究刍议——观察模型、典型问题与对网络空间国际法的启示

Preliminary Thoughts on Legal Study of Cyberspace——Observing Model,Typical Problems and Implications on Cyberspace International Law

晚近,作为物理空间越来越完备的同态映射,网络空间已成为生产生活乃至国家博弈的新场域。对网络空间的法学研究需要尽快适应此种态势。从方法论上看,一方面,网络空间法学研究需要以传统法学研究为基础;另一方面,应当结合网络空间的特征,构建恰当的观察模型,以便对网络治理的法学问题进行定位和拆解。不论是研究网络空间与外层空间的交叉法律问题或者网络空间战略稳定博弈的法律问题,还是对网络空间国际法的其他热点议题而言,都需要从这两方面着手推进。

Recently,as an increasingly complete homomorphic mapping of physical space,cyberspace has become a new space of production and living for common people,as well as a new forum for strategic competition for states.Legal research of cyberspace needs to adapt to this situation as soon as possible.Methodologically speaking,on the one hand,the study of cyberspace law needs to be based on the traditional legal study.On the other hand,one should combine the characteristics of cyberspace to extract an appropriate observation model,so as to locate and disassemble the legal problems of cyber governance.Both the legal issues concerning the intersection of cyberspace and outer space,the legal issues concerning the strategic stability in cyberspace,and other key issues of cyberspace international law need to be advanced from these two aspects.
