The Civil Nature of the Civil Code

我国民法典的立法宗旨和目的就是为了最大化地谋求人民的利益,这也是我国民法典的特色所在。我国民法典编纂的出发点是坚持民本,以实现和提高人民福祉为根本目的,以全面调整民事关系为根本使命,以积极解决人民群众最迫切需要解决的现实问题为根本关切,以维护家庭和谐有序为根本准则。我国民法典的核心功能是保障民权,以私权为中心构建民法典的体系,构建了完整且开放的民事权利体系,提供了较为完整的私权保障机制。我国民法典的重要任务是维护民生,注重维护个人的人身安全、财产安全和生态环境。

The legislative purpose and objective of our Civil Code is to maximize the interests of people,which is also the characteristic of our Civil Code.The starting point of the codification of the Civil Code is to adhere to the people-oriented principle,take the realization and improvement of people’s welfare as the fundamental goal,take the comprehensive adjustment of civil relations as the fundamental mission,take the active solution of the people’s most urgent practical problems as the fundamental concern,and take the maintenance of family harmony and order as the fundamental principle.The core function of the Civil Code is to protect civil rights,build a civil code system centered on private rights,build a complete and open civil rights system,and provide a relatively complete private rights guarantee mechanism.The important task of our Civil Code is to safeguard people’s livelihood,pay attention to maintaining personal safety,property security and ecological environment.
