贩卖毒品犯罪人的基本样态与综合治理--基于我国西南某市300份一审判决书

The Basic Forms and Comprehensive Management of Drug Trafficking Criminals Based on 300 First-instance Judgments of a City in Southwest China

对300份一审判决中的378名贩毒犯罪人进行研究发现其基本样态:男性和无业人员占比较大、以青壮年为主力、贩毒方式以传统小包零售和单人犯罪为主、“以贩养吸”占很大比例等。贩毒原因主要是缺乏教育和就业、“重刑治毒”的刑事政策及巨大经济利益的驱使等。综合治理应以普通民众和高危群体为目标进行不同的事前预防,逐步实现“宽严相济”的刑事政策,构建以综合治理为蓝本、预防为主导、刑罚惩治为补充的综合治理体系。

A study on 378 drug trafficking criminals from 300 first-instance convictions exposes their basic forms,which include larger proportion of the male and the unemployed,young adults domination,traditional retail and single-handed crime-oriented drug trafficking models and large proportion of cases of drug trafficking-supported drug taking.Drug trafficking is primarily attributed to lack of education and employment,the criminal policy of severe punishment-based drug management and the drive of huge economic interests.Therefore,comprehensive management of drug trafficking criminals calls for our efforts to aim at the general population and high-risk groups and take different precautions,gradually implement the criminal policy of"combining mercy with severity"and develop a comprehensive management and prevention-based comprehensive management system with punishment as supplement.
