摘要
“套路贷”犯罪活动异常高发,我国学者针对“套路贷”犯罪的研究主要集中在刑法规制和侦查对策方面,缺乏从源头、从群众出发来进行防控的研究。对“套路贷”犯罪过程和特点进行研究,尤其对浙江省近3年(2017-2019年)公开的84份“套路贷”犯罪案件的判决书进行数据分析,从基层治理的角度有针对性地探索预防和打击套路贷的路径,保护受害人权益,可以更有效地控制“套路贷”犯罪的发生。
The crime of"pre-set trap loan"crime features a high incidence.Chinese scholars'research on the crime of"pre-set trap loan"crime mainly focuses on the criminal law regulation and investigation countermeasures,which lacks efforts on research of the source and the masses-based prevention and control.Therefore,research on the characteristics and process of"pre-set trap loan"crime,especially the data analysis of the past three years'(2017-2019)84 open judgment of cases for"pre-set trap loan"crime in Zhejiang province,and grassroots management approaches-based exploration on"pre-set trap loan"crime make it more effective to protect the victim's rights and interests and control the crime of"pre-set trap loan"crime.
