论著作人格权与著作财产权行使冲突的协调

随着以著作权为核心的文化产业的蓬勃发展,转让著作权成为作者实现经济利益的一种重要途径。在著作权转让中,无论是基于法定还是约定的原因,都有可能出现著作人格权与已转让出去的著作财产权分属不同主体的情况,这种主体的分离性势必会产生权利行使上的冲突,不仅影响著作财产权的稳定利用,最终也将抑制著作权的转让交易,阻碍文化产业的发展。通过对基于同一作品的著作人格权与著作财产权行使冲突的分析,得出协调二者冲突应在坚持利益平衡这一根本原则的前提下,遵循以服从著作财产权转让的特定目的和以促进作品的再创作为具体原则,并依此提出了若干相应的修法建议。
