特殊时期处理劳动争议机制的创新

摘要 新型冠状病毒肺炎爆发后,行政司法部门为了减少人与人之间的接触,案件延期审理。只有变革处理劳动争议机制,才能最大程度地避免受到疫情影响,更利于劳动争议案件仲裁与诉讼的对接。第一,将劳动争议仲裁裁决变革为行政裁决,作为引入复议程序的前提;第二,在劳动争议仲裁程序中引入复议机制,实行劳动争议案件“复议前置”,对应“一裁终局”案件“一审终审”制引入“两级仲裁”制。劳动争议案件审理机制的创新,有利于提高行政司法机关的效能,符合深化行政司法机制改革精神,能够使案件审理工作在疫情等特殊时期照常进行。 After the outbreak of the new coronary pneumonia,the administration of justice postponed the trial of cases in order to reduce contact with each other.Only by reforming the mechanism of handling labor disputes can we avoid being affected by the epidemics and at the same time more conducive to the abutment of arbitration and lawsuit.First,change the labor dispute arbitration award into administrative arbitrament as the premise of introducing the reconsideration procedure.Secondly,a reconsideration mechanism is introduced into the labor dispute arbitration procedure,and the system of"pre-review"is implemented,introducing“two-level arbitration”in correspondence to"final award"in"first instance"cases.The innovation of the trial mechanism of labor dispute cases is conducive to improving the efficiency of the administrative and judicial organs,in line with the spirit of deepening the reform of the administrative and judicial mechanism,and can enable the trial of cases to proceed as usual in special periods such as the epidemic situation.
