论我国《外国人永久居留管理条例》的完善——以日本为参考

On the Improvement of Regulations on Permanent Residence of Foreigners in China——Take Japan as a Reference

司法部发布的《中华人民共和国外国人永久居留管理条例(证求意见稿)》(以下简称《外国人永久居留管理条例》)在外国人申请永久居留权的申请条件方面引发了社会各界的巨大争议。为了完善该条例关于申请条件的规定,减少法律漏洞,以日本作为参考国家,运用比较研究方法,概括永久居留权的基本概念和权利构造,探讨中日永久居留权的申请条件及异同点,并在“突出贡献具体标准”“高端人才积分配额制”“担保人连带责任制”“犯罪记录实质性调查”以及设立“合理过渡期”五方面提出改进建议,阐明《外国人永久居留管理条例》有关申请条件的具体改进路径。

The Regulations of the people’s Republic of China on the administration of permanent residence of foreigners——Draft for comments(Hereinafter referred to as Regulations on the Administration of Permanent Residence of Foreigners)released by Ministry of Justicerecently has made huge controversy in all sectors of society in terms of the conditions for foreigners to apply for permanent residency.In order to improve the provisions of the Regulations on application conditions and reduce legal loopholes,Japan was used as a reference country to use comparative research methods to summarize the basic concepts and rights structures of permanent residency and discuss the application conditions and similarities and differences between China and Japan for permanent residency Points,and put forward suggestions for improvement in five aspects:“highlighting specific standards for contribution”“high-end talent credit quota system”“guarantor joint liability system”“substantive criminal record investigation”and“establishing a reasonable transition period”,clarify the specific improvement path for the application conditions of the Regulations on the Administration of Permanent Residence of Foreigners.
