我国警察法治评估:指标体系、法学意蕴与逻辑建构

Chinese Police Rule of Law Assessment:Indicator System,Legal Implication and Logical Construction

随着时代嬗变与法治发展,我国警察法治评估关系到法治政府的建设质量与建设速度。就警察法治这一复杂的法学现象而言,可潜心镜鉴国际上比较通行的评估做法,选用指标体系而非规范概念。我国警察法治评估的法学意蕴主要是有利于多层次强化法律权威以及有利于多角度保障人权。在重点分析我国警察法治评估的变量后,需要有针对性地提出警察法治评估的逻辑建构路径:一为适当增加"薄"的法治概念作为警察法治评估的变量,二为建立警察法治评估的联动合力机制。

With the change of the times and the development of the rule of law,the evaluation of the rule of law in China's police is related to the quality of construction and the speed of construction of the rule of law government.In terms of the complex legal phenomenon of the police rule of law,it is possible to use the indicator system rather than the normative concept.The legal implication of the police's rule of law assessment in China is mainly to help strengthen the legal authority at multiple levels and to protect human rights from multiple angles.After focusing on the analysis of the variables of the police's rule of law assessment in China,a logical construction path for the police rule of law assessment needs to be targeted:one is to appropriately increase the"thin"concept of the rule of law as a variable in the police's rule of law assessment;the second is to establish a joint force mechanism for police rule of law evaluation.
