The Legal Framework for Regulating the New Business Format of Express in the Context of“Internet Plus”

"互联网+"与快递行业的结合,在催生快递新业态的同时,也给政府规制带来了新的挑战。在具体规制中,表现出规制理念不明确、规制依据不足、规制主体与对象不确定、规制方式滞后和规制内容不聚焦等问题,亟需构建起快递新业态规制的法律框架。规制理念上,要在严格规制与放松规制中寻找平衡,正确理解包容审慎规制理念;规制依据上,注意现有立法的援引与专门立法的出台;规制主体上,重视规制者的确定与被规制者的明晰;规制方式上,构建符合快递新业态需要的多元规制方式;规制内容上,把握新业态规制的重点方向,聚焦服务质量和安全问题。

The combination of“Internet Plus”and the express industry not only produces the new business format of express,but also brings new challenges to governmental regulation.In the specific regulation,we are faced with such problems as unclear regulation ideas,insufficient regulation basis,uncertain regulation subject and regulation object,lagging regulatory approach,and non-focusing regulation contents.It is urgent to build a legal framework for regulating the new business format of express,including:in terms of regulation ideas,to search for a balance between strict regulation and relaxed regulation and to correctly understand the regulation conception of inclusion and prudence;in terms of regulation basis,to pay attention to the citation of existing legislation and the introduction of special legislation;in terms of regulation subject,to emphasize the determination of the regulator and the clarity of the regulated;in terms of regulatory approach,to build a diversified regulatory approach that meets the needs of the new business format of express;in terms of regulation contents,to grasp the key direction of regulating the new business format and to focus on service quality and security.
