我国农村垃圾治理的法治化路径研究

Research on the Path of Legalization of Rural Waste Treatment in China

关于农村垃圾的治理,全国没有基本性法律作出专门的详细规定,只有相关的环境保护法律进行了概括性规定,所以结合我国国情,尝试进行法治化路径的解决。首先,从当前农村垃圾的治理现状着手,指出农村垃圾治理中存在的主体权责不清晰、投入经费保障不足、垃圾治理立法落后这三大问题。其次,从重发展轻治理的历史延续、重城市轻农村的发展思路、农民传统观念和生活习惯的影响方面分析了农村垃圾治理的困境。最后,提出明确农村垃圾治理监督的责任主体、健全农村垃圾治理资金投入机制、构建合作共治模式的法治化对策。

Regarding the management of rural waste,there are no specific provisions in the national basic law,but only general provisions in the relevant environmental protection law.So in combination with China's national conditions,the paper tries to solve the problem by legalization.First of all,from the current rural waste treatment,it points out three problems in the rural waste treatment,which are unclear major powers and responsibilities,inadequate investment guarantee,and backward legislation on waste management.Second,the dilemma of rural garbage treatment is analyzed from the aspects of the historical continuation that emphasizes development rather than governance,the influence of development ideas that emphasize cities rather than rural areas,and the influence of farmers'traditional ideas and lifestyles.In the end,it clarifies the main body of responsibility in the supervision of rural garbage management,improve the investment mechanism of rural waste management funds,and build a cooperative and co-governance model.
