Breakthrough and Construction--the Design for Constitution of Empire of Pufendorf

普芬道夫使自然法摆脱宗教神学的束缚,成功实现世俗化。他基于社会契约思想,提出"二重契约"建国理论,并通过自然法义务理论及自然权利阐述实现永久和平、优化国家内部治理及建构国际秩序的路径。普芬道夫进行帝国宪制设计,从主权归属上论述帝国的不规范性及其混乱现状,为帝国设计规范的政体;对国家体系如何有效运行提出协调法权平等与实质不平等的方法;为反对外敌对帝国宪制的阻碍及威胁,普芬道夫试图从军事及宗教政策视角出发,构建统一对外的防御战线。

Pufendorf freed the natural law from the shackles of religious theology and realized secularization.Based on the thought of social contract,he put forward the state founding theory of"double contract".According to the theory of natural law obligation and natural rights,he expounded the path to achieve permanent peace,optimize the governance of the state and build the international order.Pufendorf designed the constitution of the empire and discussed the current confusion situation and irregularity of the empire in terms of sovereignty ownership,and designs the regular regime for the Empire,he put forward the measures to coordinate the equality of rights and the substantive inequality for the effective operation of the system of states,and oppose the obstacles and threats of foreign enemies to the constitution of the empire,Pufendorf tried to build a unified defense front from the perspective of military and religious policies.
