最高人民法院的案例指导要通过指导性案例体现出来,而指导性案例的裁判要点是法院、检察院和当事人等参照和引述的主要内容。已有的指导性案例可以类型化为原则、概念、规则以及说理、裁量方法等,存在着同一功能语词表述不统一、冗长和个案化等问题,需要根据不同情况统一表述、去粗取精、适当抽象。指导性案例裁判要点表述技术的提升是由其功能定位决定的,不管是统一、精减还是抽象,都要以有利于案件准确概括、有利于法律精细化解释和方便引述为目标。

The case guidance of the Supreme People’s Court should be reflected through guiding cases,and the ruling points of guiding cases are the main contents for reference and quotation of the court,procurators and litigants etc.The existing guiding cases can be classified into principles,definitions,rules and reasoning and discretion.As for the expression of the guiding cases,there are problems such as lack of consistency in function words,lengthy expression and unrepresentative cases selected.Therefore,it needs to be unified,simplified and abstracted whenever necessary.The improvement of the expressing technique of the ruling points of guiding cases depends on the function of guiding cases,with the goal of summarizing the cases accurately,interpreting the cases specifically by law and quoting conveniently.
