摘要
《粤港澳大湾区发展规划纲要》明确提出将粤港澳大湾区打造为内地和港澳深度合作示范区,建设好粤港澳大湾区是国家治理体系和治理能力现代化的体现,粤港澳大湾区法治合作越发受到重视。探寻粤港澳大湾区法治合作的立法路径,首先需要分析粤港澳大湾区法治合作的立法现状,以确定推动粤港澳大湾区法治合作的立法重点。随后本文讨论粤港澳大湾区示范立法模式的选择,并在此模式下具体分析大湾区九市的示范立法权限,并运用上述示范立法权限,建立完善以"四共"即共同、共通、共享、共治为基础的粤港澳大湾区法治合作机制,为内地和港澳深度合作提供"湾区经验"。
The Development Plan for Guangdong-Hong Kong-Macao Greater Bay Area proclaimed to build Guangdong-Hong Kong-Macao Greater Bay Area as a demonstration area for in-depth cooperation among the Mainland,Hong Kong and Macao,and showcase the modernization of the national governance system and governance capacity.Thus,the legal cooperation in Guangdong-Hong Kong-Macao Greater Bay Area attracted more and more attention.To explore the legislative path of legal cooperation in Guangdong-Hong Kong-Macao Greater Bay Area,it is necessary to analyze the current legislative situation of legal cooperation in this Area to determine the key issues.This paper discusses the choice of model legislation in the Greater Bay Area,and analyzes the legislation authority of nine cities in Greater Bay Area in detail under this model.It also proposes to establish and improve the legal cooperation mechanism in the Greater Bay Area based on four key factors.
