“公立高校举办者”概念的规范分析

On the Founder of the Public Higher Educational Institution:A Normative Analysis on the Concept

公立高校的举办者是高等教育法律关系中的重要主体,也是政府在高等教育治理中扮演的一个重要角色,其权利义务边界是构建政府、高校与社会之间新型关系的基础。但实践中人们对"公立高校举办者"内涵的理解仍然含混,对政府作为举办者与管理者的职能差异存在认知盲区。要重视高等教育管理体制中的举办者身份,应进一步明晰举办者的概念和内涵,厘清不同层级政府部门作为举办者和管理者的职能身份及权利义务。

As one of the critical entities in legal relation concerning higher education,the founder of the public HEI is a significant role played by government in higher education governance.The boundary between its right and obligation constitutes the foundation to establish a new triangle-pattern among the government,the HEI and the society.Connotation of the founder of the public HEI in practice,however,is still chaotic.Yet there’s no clear understanding of distinct function between the government as the founder and it as the administrator.Identity of the founder in higher education system should be highly regarded.It is expected to further clarify its concept and connotation,especially the functional identity and right&obligation taken by multi-level government agencies as founders and administrators.
