少数民族生态伦理内源性资源当代价值研究——以绿色犯罪学为视域

Research on the Contemporary Value of Endogenous Resources of Eco-ethics of Minorities:Based on the Perspective of Green Criminology

面对当代全球生态危机,从保护生态环境、维护人类及一切生命体权利和安全的绿色犯罪学立场出发,面向少数民族生态伦理资源,从“万物平等”原始自然观、“敬畏自然”自然崇拜以及尊奉“和谐共生”的民族习惯法中发现并提炼民族生态伦理思想。以自然体内在价值论、敬畏生命、天赋权利论等绿色犯罪学基础理论论证世间自然体的平等性,提出“生态正义观”解决人与自然的冲突和矛盾。重新解读民族生态伦理资源当代价值和功能,树立“山水林田湖草生命共同体”理念为绿色犯罪学价值导向,以积极预防观为生态环境犯罪应对策略、民族生态伦理实践为法律实施辅助,从而实现民族生态伦理资源在现代社会的展开,为民众提供生态环境本体性安全保障。

Facing the ecological crisis of contemporary society,From the standpoint of green criminology protecting the environment,safeguarding the rights and safety of human beings and all life forms,taking the ecological ethical resources of ethnic minorities as the research objects,starting from the“natural equality of all things”primitive nature view,“respecting nature”and worshiping and respecting“harmony and symbiosis”found and refined the national ecological ethics in the customary national law.Demonstrating the equality of natural bodies in the world with the core theories of green criminology,such as the theory of intrinsic value of nature,the awe of life,and the theory of natural rights,propose to solve the conflicts and contradictions between man and nature with“ecological justice concept”,reinterpreting the contemporary value and function of ethnic ecological ethics resources,and putting forward the concept of“The Community of Life in Mountains,Rivers,Forests,Fields,Lakes and Grass”as the value guide of China′s green criminology.Taking active prevention as the countermeasure for ecological crime,and the national ecological ethics practice as a supplement to law,to realize the national ecological ethics resources under the modern society to provide the ontological safety guarantee for the masses′environment.
