行政长官对中央人民政府负责制度:宪制基础与制度完善

Responsibility System of Chief Executive towards Central Government:Constitutional Foundation and Institutional Improvement

特别行政区行政长官对中央人民政府负责是强化一个中国原则、落实中央监督权的重要举措,主要体现在两项制度之中,即中央人民政府任免行政长官和行政长官向中央人民政府述职、报告特区重大事项。法律层面对任免制度和报告制度的规范阙如是行政长官对中央人民政府负责的主要障碍,需要在坚持宪法和基本法的宪制基础、坚持“一国两制”的前提下实现全面管治权和高度自治权有机统一、遵照国家治理体系和治理能力现代化的标准完善行政长官对中央人民政府负责制度。

Holding Chief Executive responsible to central government is an important measure of strengthening one China principle and fulfilling central supervision power that manifest in two institutions:central government nominates and removes the position of chief executive,and chief executive reports its work and major events to central government.Lack of norms of approval and remal system and report system is the major obstacle of taking chief executive accountable to the central government,and we need to solidly improve the responsibility system of chief executive toward central government to enhance the state governance modernization by insisting on‘One Country,Two System’principle with overall jurisdiction and high autonomy based on the Constitutional order.
