Education and Cultivation of Judicial Professional Ethics in Ancient China and Its Modern Enlightenment

在司法伦理高度发达的中国古代,司法职业伦理往往是作为社会伦理和个人伦理的组成部分,对司法者的司法行为发挥着规范和引导作用。尽管当代司法活动与古代司法活动存在较大的区别,但司法活动中相关要素的共同性又使两者呈现某些相通之处。应当看到,中国古代某些具体司法职业伦理要求及教育培养在当代仍有其现实意义,在借鉴古代优秀传统的基础上,当代司法职业伦理建设必须要重视司法职业群体的形象建设,同时创新教育培养方法,才能树立司法的权威性,提升其公信力。

In ancient China,where ethical judicature was highly developed,judicial professional ethics was often a component of social ethics and personal ethics,which played a role in regulating and guiding the judicial behavior of judicial officers.Although there are great differences between contemporary judicial activities and ancient judicial activities,due to the common nature of related elements in judicial activities,they have some similarities.It should be noted that some specific judicial professional ethics requirements and their education in ancient China still have practical significance in contemporary times.On the basis of drawing on the ancient excellent traditions,the construction of contemporary judicial professional ethics must pay attention to the professional image construction of judicial professional groups,and at the same time innovate education training methods,so that it is possible to establish judicial authority and enhance its credibility.
