摘要
无论是从利益平衡视角来看,还是为了更好地保障和促进网络游戏直播产业的健康发展,网络游戏直播行为都不宜被认定为合理使用。在未经游戏著作权人许可授权的情况下,擅自在互联网上公开传播游戏运行画面的行为属于侵权行为。网络游戏直播行为无法受到信息网络传播权的控制,也难以被纳入现行立法中表演权和广播权的调整范围,目前只能用"应当由著作权人享有的其他权利"这一兜底性条款对其加以规制。
Whether from the perspective of balance of interests,or to better protect and promote the healthy develop⁃ment of the online game live broadcast industry,online game live streaming should not be considered as fair use.With⁃out the permission or authorization of the game copyright owner,the act of publicly disseminating the running picture of the online game is an infringement.Online game live streaming cannot be controlled by the information network dis⁃semination right,nor can they be included in the scope of performance rights and broadcasting rights in current legisla⁃tion.At present online game live streaming can only be regulated by the"other rights that should be enjoyed by copy⁃right owners".
