省级CDC收取非免疫规划疫苗配送费用法律问题探讨

依据《疫苗管理法》,省级CDC可以对本行政范围内的非免疫规划疫苗实行统一配送管理。基于综合考量,省级CDC委托疫苗配送单位储存和冷链运输非免疫规划疫苗具有合理性及充分的法律依据,非免疫规划疫苗的配送费用应由疫苗上市许可持有人承担。省级CDC向疫苗上市许可持有人收取的非免疫规划疫苗配送费用属于非免疫规划疫苗冷链储存、冷链运输过程中实际发生的流通成本,不属于行政事业收费。关于非免疫规划疫苗配送费用的构成、标准,可参照"分段接力方式"计算,严格按照相关法律、法规、政策收取。

According to the Vaccine Management Law,provincial CDCs can uniformly manage the delivery of non-EPI vaccines within their administrative scope;based on comprehensive considerations,provincial CDCs commission vaccine delivery units to store and cold-chain transport non-EPI vaccines are reasonable and have adequate Legal basis;the delivery costs for non-EPI vaccines should be borne by the holder of the vaccine marketing authorization.The non-EPI vaccines fee charged by the provincial CDC to the vaccine marketing authorization holders is the actual circulation cost incurred during the cold-chain storage and cold-chain transportation of non-EPI vaccines and is not an administrative fee.Regarding the composition and standard of non-EPI vaccines delivery costs,we can refer to the"segmented relay method"to calculate non-EPI vaccines delivery costs in sections.The fees should be collected in strict accordance with relevant laws,regulations,and policies and relying on the market pricing mechanism,the total is obtained.
