刍议新《药品管理法》下药品价格监管的法律进路

On the legal supervision of drug prices under the new Pharmaceutical Administration Law

尽管新修订的《药品管理法》修改了同药品价格监管相关的部分规范,但并未纾解药价法律监管业已存在的结构性问题。我国药品价格监管的法律制度仍不完备、药品价格的形成机制尚不健全、药品价格的市场监管相对乏力,连同药品价格的权力寻租仍然存在。新《药品管理法》贯彻约束与激励相容的监管模式,不仅体现了社会本位、适度干预和依法监管的法治原则,更指出通过完善药品价格监管法律体系、持续优化药品价格形成机制、增强药品流通市场行政监管和压缩药品价格权力寻租,开启《药品管理法》修订背景下我国药品价格法律监管的未来路径。

Although the new Pharmaceutical Administration Law has revised some norms related to drug price regulation,it has not eased the existing structural problems in drug price regulation.The legal system of drug price supervision in China is still incomplete,the formation mechanism of drug price supervision is not perfect,the market supervision of drug price is relatively weak and the rent-seeking of drug price supervision is still rampant.The new Pharmaceutical Administration Law to carry out the supervision model of constraint and incentive compatibility,embodies the principle of social orientation,appropriate intervention and regulation under the rule of law,pointed out that more by improving drug price supervision legal system,the continuous optimization of drug price formation mechanism,strengthen the drug circulation market administrative drug price regulation and compression supervision power rent-seeking,opens the future revised path of drug prices supervision in our country.
