摘要
2019年4月10日《医疗机构投诉管理办法》正式施行,其中第四十七条规定"本办法所称患者,包括患者及其近亲属、委托代理人、法定代理人、陪同患者就医人员等有关人员"。虽然这种对"患者"的定义有积极的一面,但该概念解释也存在一定问题。尝试通过对患者概念的回溯性分析,对该办法中第四十七条的亮点、问题进行整理,希望从立法技术和语义分析层面对该条立法提出完善建议。
April 10,2019,The Measures of Complaints For Medical Institutions came into force.The article 47 is the patients as mentioned in the Measures includes patients and their close relatives,entrusted agents,legal agents,and other relevant personnels.The definition of patient is not accurate.The authors tried to analyze the definition of patients and put forward the suggestions for the improvement of the legislation technology.
