认罪认罚从宽制度是刑事诉讼法确立的一项重要制度,它要求量刑在数量层面更精细、精准和透明。然而,量刑规范化指导意见下的刑罚裁量,并未从大数据角度予以积极回应,难以实现类案类判。为此,借助大数据人工智能技术,对海量的司法判决文书进行深入挖掘、分析,依规构建量刑模型,依规提炼量刑情节,依规确立量刑规则,实证辅助确定量刑参数,实证辅助确定量刑起点,实证辅助确定宣告刑,实证辅助保障量刑的高效与透明,由此实现精准量刑,充分体现罪责相适应原则。

The implementation of the leniency system of peccavi and accepting punishment requires that the sentencing be more precise,accurate and transparent in terms of quantity;however,the sentencing under the guidance on the standardization of sentencing did not actively respond from the perspective of big data,making it difficult to achieve sentencing by referring to the sentence of cases with similarity.Therefore,for numerous judicial decision documents,the big data artificial intelligence technology is used to construct a sentencing model,to extract the sentencing plot,to establish the sentencing rules,according to the regulations,and to determine the sentencing parameters,to determine the starting point of sentencing,and to determine the declared sentence,to ensure the efficiency and transparency of sentencing,by empirical support,thereby achieving precise sentencing.
