摘要
直销作为经销方式的一种,本身是合法的,受直销与传销的易混淆性影响,直销行业问题频出,出于“以监管促发展”的考量,目前仍需加强对于直销行业的监管。而在“共建共治共享”的社会背景下,对于直销行业的监管需要借鉴“社会共治”的模式,充分运用社会各方面的力量对直销进行监管。通过将直销行业置入整体经济、政治环境下,分析我国直销行业监管的现状,并通过对世界主要直销监管模式的梳理,就如何监管提出我国应设立直销行业协会的建议,并进一步分析其合理性与可行性。
As one of the distribution modes,direct selling is legal.Due to the confusion between direct selling and pyramid selling,problems in the direct selling industry occur frequently.For the purpose of“promoting development by supervision”,it is still necessary to strengthen the supervision of the direct selling industry.Under the social background of“co-construction,co-governance and sharing”,the supervision of direct selling industry should learn from the model of“social co-governance”and make full use of the social forces.Placing the direct selling industry into the overall economic and political environment,this paper analyzes the current supervision on China’s direct selling industry,proposes to establish a direct selling industry association through sorting out the world’s main direct selling supervision model,and further analyzes its rationality and feasibility.
