推进“劳动股份制”立法的思考——华为公司实践经验的启示

摘要 “劳动股份制”是让劳动者参与分享企业利润的一种法律制度,即劳动者可与投资者通过共决等方式,确定双方分享企业一定比例的利润,并在此比例确定的范围内,投资者按照《公司法》等相应的规定,劳动者按照“劳动股份制”立法的规定分享利润并承担义务,促使两者的立法相互衔接与协调。在国际社会经济危机频发,某些资本主义强国愈发难以转嫁经济危机、资本已是相对过剩的背景下,坚持“以人民为中心”,推进“劳动股份制”的专门立法,完善配套的法律制度,保障劳动者对剩余价值所应享有的权益,促进资本积累与劳动力扩大再生产的相对平衡,是达到经济社会可持续的高质量发展的法律保障,也是反对经济霸权干涉、阻止资本主义国家转嫁危机的长效法律措施,这将对于一切遵循经济全球化规则,致力于和平与发展的民族与国家,具有一定的普适性。 “Labor shareholding system”is a legal system that allows laborers to participate in the sharing of corporate profits,that is,laborers and investors can determine that both parties share a certain proportion of the profits of the enterprise through co-determination and other methods,and within the range determined by this proportion,investors according to the“Company Law”and other corresponding regulations,laborers in accordance with the provisions of the“labor shareholding system”legislation,have rights and obligations for profits,which promotes the convergence and coordination of the two legislations.In the context of frequent international social and economic crises,it is increasingly difficult for certain capitalist powers to pass on the economic crisis,and capital is already relatively surplus.To adhere to the“people-centered”,promote the“labor shareholding”special legislation,improve the supporting legal system,protect the rights and interests of laborers to the surplus value and promote the relative balance between capital accumulation and labor expansion and reproduction is the legal guarantee for achieving high-quality economic and social sustainable development,as well as opposing economic hegemony and preventing capitalist countries from passing on the crisis Long-term legal measures;this will have certain universality for all nations and countries that follow the rules of economic globalization and are committed to peace and development.
