劳动法语境下农民工权益保护研究

Research on the Protection of Peasant Workers’Rights and Interests in the Context of Labor Law

农民工是城市化发展过程中的新生弱势群体,对农民工权益保护问题进行研究有利于促进城乡协调、社会稳定发展。纵观劳动法发展历史,制定劳动法的出发点是为了使社会中每一个劳动成员都能切实享受到因劳动而获得的基本权益。而要实现这一目标,必须要从劳动法自身语境出发,践行劳动法的特质,不仅要保护劳动生活中每一位劳动者的基本权利,也要通过法律对策研究对农民工群体基本权益予以特殊保护。当代劳动法所体现的正义价值是保护农民工权益的法理基础,劳动法的法律规制亦是保护弱者权益的法制前提,农民工基本权益保障则是社会主义国家践行法治精神的必然要求。

Migrant workers are the new vulnerable groups in the process of urbanization.Research on migrant workers’rights and interests is conducive to promoting urban and rural coordination and social stability.Throughout the history of the development of labor law,labor law is formulated to make every member enjoy the basic rights and interests effectively,which we have to protect the basic rights of every laborer,including migrant workers through legal countermeasures.The justice value embodied in contemporary labor law is the legal basis of protecting the rights and interests of migrant workers,the legal regulation of labor law is also the legal premise of protecting the rights of the weak,and the basic rights and interests of migrant workers are the inevitable requirement of socialist countries to practice the spirit of the rule of law.
