区块链分布式记账系统作为一种划时代的技术,可以有效推动数字化的颠覆性变革。但是重大技术革新往往巨大正面效应与潜在负面效应并存。和人工智能等其他热门技术相比,区块链技术有共性也有个性。共性在于国家重视程度高、发展规模失衡、基础研究弱、未来前景乐观四个方面,个性则为共识机制、去中心化点对点系统和哈希算法。这些特点导致区块链技术的两面性集中于法律和金融领域,表现为区块链经济带来的法律新问题和区块链金融引起的创造性毁灭。我们应全面客观地看待区块链技术的两面性,既积极乐观,又审慎理性。

As an epoch-making technology,block chain distributed bookkeeping system can effectively promote the subversive change of digitalization.However,major technological innovations often coexist with huge positive effects and potential negative effects.Compared with other hot technologies such as artificial intelligence,block chain technology has both universalities and individualities.The universalities lie in four aspects:high national attention,unbalanced development scale,weak fundamental research and optimistic future prospect,while the individualities are consensus mechanism,decentralized peer-to-peer system and hash algorithm.The dual character of block chain technology that these characteristics lead to concentrates on the legal and financial fields,which are manifested in the new legal problems brought by the block chain economy and the creative destruction caused by the block chain finance.We should take a comprehensive and objective view of the dual character of block chain technology,both positive and optimistic,and prudent and rational.
