摘要
编造、故意传播虚假信息具备重大法益侵害风险,特别是在新冠肺炎疫情等重大突发公共卫生事件中,需从严规制。文章认为应在厘清"虚假信息"边界,确保政府部门及时、准确发布疫情信息的基础上,促进网络监管部门与网络服务提供者在法治轨道内充分发挥技术治理机制作用,支持司法机关依法从严适用编造、故意传播虚假信息罪,实现对此类犯罪行为的精准打击,以保障疫情防控工作在法治轨道内顺利推进。
Fabricating and deliberately disseminating false information carries a significant risk of violating legal interests,especially in major public health emergencies such as COVID-19 epidemic,which requires strict governance.The article believes that on the basis of clarifying the boundary of"false information"and ensuring that government departments release timely and accurate information on the epidemic,it should be down to promote the network supervision departments and the internet service providers to give full play to the technical governance mechanism within the orbit of rule of law,support judicial authorities to strictly apply the crime of fabricating and intentionally disseminating false information in accordance with the law,and achieve a precise crackdown on such crimes,so as to ensure the smooth progress of the epidemic prevention and control work within the orbit of rule of law.
