从比特币的法律性质谈比特币纠纷的裁决思路

The Adjudication of Bitcoin Disputes from the Perspective of the Legal Nature of Bitcoin

目前,各类争议解决机构关于比特币类纠纷裁决存在较大差异,反映了实践中争议解决机构对比特币在我国现行监管体制下的法律性质的认识还存在差异。笔者尝试厘清比特币在我国现行法律框架下的法律属性,并分析我国争议解决机构对涉及比特币的五类纠纷的裁决思路,在此基础上提出完善建议,以期对此类纠纷解决有所助益。

At present,there are great differences in the adjudications on bitcoin disputes of different dispute resolution institutions,which reflect the differences in the understanding on the legal nature of bitcoin under the current regulatory system in different dispute resolution institutions.The author attempts to clarify the legal nature of bitcoin under the current legal framework in China,and analyzes the ideas of adjudications of five types of bitcoin disputes made by Chinese dispute resolution institutions and then provides some suggestions。
