摘要
预售商品房抵押预告登记权利人是否享有优先受偿权在理论上和司法实践中一直存在较大分歧。通过实证研究方法和理论研究方法分析可见,预售商品房抵押存在很多不完善的地方,债权人可能因开发商和购房人的过错而利益受损。附条件的赋予抵押权预告登记优先受偿权不仅有利于保护银行资金安全和房地产行业的健康发展,也有利于实现民法维护交易公平的价值。在《民法典》的编纂之际,应考虑将预售商品房抵押制度在《民法典物权编》做出明确的规定以完善抵押权预告登记制度。
There have always existed great differences in theory and juridical practice in whether the pre-notice registration obliges have the compensation right of priority,and whether the pre-notice registration oblige of pre-sale commercial house mortgages have the right of priority to compensation.Through the analysis of empirical and theoretical research methods,it can be seen that there are many imperfections in the pre-sale of commercial housing mortgages,creditors may suffer from benefit lost due to the faults of developers and buyers.To entitle conditional right of priority to compensation with is not only conducive to protecting the safety of bank funds and the healthy development of the real estate industry,but also to achieving the fair value of civil law and maintaining transaction fairness.At the time of the compilation of the Civil Code,consideration should be given to the provision of a mortgage system for pre-sale commercial houses in the Civil Code Real Right Compilation to make clear the mortgage registration system.
