黑恶势力犯罪追求非法控制社会的天性,决定了对其治理必然具有政治与法律双重意义。在不断完善黑恶势力犯罪治理的法律体系,推进黑恶势力犯罪治理的广度与深度的同时,有必要重新审视其间涉及的基础问题。在厘清黑恶势力犯罪与共同犯罪、有组织犯罪的关系的基础之上,明确普通恶势力、恶势力犯罪集团、黑社会性质组织之间的关联与界分,重视预防刑法视域下组织黑社会性质组织行为的刑法评价对黑恶势力犯罪治理的影响。这些问题是治理黑恶势力犯罪的基础,对其深化研究也将有助于此次专项斗争法律效果与政治效果的进一步提升。

Since the nature of the gang-related crimes is the pursuit of illegal control of the society,it is both of political and legal significance to control them.While constantly improving the legal system and promoting the breadth and depth of the criminal management of the evil forces,it is necessary to reexamine the basic issues involved.On the basis of clarifying the relationship among gang-related crimes,joint crimes and organized crimes,it is necessary to further identify the connections and boundaries between the usual evil forces,the criminal group of evil forces and the mafia-style organizations,pay more attention to the criminal evaluation of the behavior of the mafia-style organizations under the criminal law,and its effects on criminal governance.These problems are the foundation of governance of gang-related crimes.study on this issue would help improve the effectiveness of the crimes controlling program in policies and laws.
