党内法规的溢出效力是党内法规超越管党治党的传统界限,而能够调整国家事务、社会事务,规范非党组织与党外人士的一种约束力。党建的“必需”理论、党的领导权理论、党政合作理论从不同的角度证成了党内法规溢出效力的正当性,也为厘清党内法规溢出效力的边界提供了理论指导。党内法规溢出效力表现相当复杂,但在长期的法治实践中,实际上形成了AX型、AY型、BX型、BY型。为了充分发挥上述类型的指引、塑造、评价功能,应重点明确其内涵特征,并从中梳理出党内法规溢出边界的判断基准,即AX型的“必需”基准、AY型的党政共治基准、BX型的政治判断基准、BY型的直接管理基准。
