我国行政公益诉讼确认违法判决的困境及完善

Problems and Its Resolutions about Judgments of the Confirmation of Violation in Administrative Public Interest Litigation

确认违法判决是我国行政公益诉讼的主要判决方式,也是其法律适用现有主要纰漏的集中体现。因客观诉讼与主观诉讼的法理冲突,以及司法实践中对确认违法判决法律定位认识不足,以及诉前程序的过滤功能未能充分发挥等原因,目前我国行政公益诉讼确认违法判决存在起诉条件不一,审查期间不明,违反检察建议制度的法律后果不确定,判决结论适用混乱等主要问题。应通过遵循复合式起诉条件,准确确定审查范围,确认逾期或未予回复检察建议的行为违法,详细释明判决结论适用标准等举措来加以规范,从而有效督促依法行政,切实保障国家利益与社会公共利益的稳妥实现。

The confirmation of violation is one of the main judgments in the administrative public interest litigation in China,and it is also the concentrated reflection of the main defects in the application of law.Due to the conflict of legal principle between objective and subjective litigation,the lack of understanding of the legal position of affirming illegal judgment in judicial practice,and the failure of the filtering function of pre-litigation procedure,etc.,at present,there are some main problems in the confirmation of illegal judgment in Administrative Public Interest Litigation,such as different prosecution conditions,unclear review period,uncertain legal consequence of violating the procuratorial suggestion system,confused application of Judgment Conclusion,should be regulated by following complex prosecution conditions,accurately determining the scope of review,recognizing violations of the law in cases of late or non-response to prosecutorial recommendations,and specifying in detail the criteria to be applied in sentencing conclusions,so as to effectively urge administration in accordance with the law,to ensure the steady realization of national interests and social public interests.
