新条例下有色冶金施工企业在工程分包中的应对措施

《保障农民工工资支付条例》自2020年5月1日起实施,是确保农民工工资支付,维护从业农民工足额和及时拿得工资收入权利的一部法律条文,是我国迄今为止工资方面的最高层次立法。该条例对工程建设领域进行了特别规定。随着建设项目的增加与规模的提升,众多富余农村劳动力推入了基础设施建设行业,间接推动建筑施工劳务分包行业的发展,同时在发展中也出现了数量较大的不规范建筑劳务施工企业。施工总承包单位作为工程建设领域的重要参与者,根据条例的规定,必须要建立和完善劳务分包制度,提高工程项目劳务队伍的实名制普及率,以保障农民工工资的足额支付和避免承担相应的法律后果。

The regulation on ensuring the payment of migrant workers'wages has been implemented since May 1,2020.It is a legal provision to ensure the payment of migrant workers'wages and to safeguard the right of migrant workers to receive wages in full and in time.It is the highest level of legislation on wages in China so far.The regulation makes special provisions in the field of engineering construction.With the increase of construction projects and the promotion of scale,many surplus rural labor force has been pushed into the infrastructure construction industry,indirectly promoting the development of construction labor subcontracting industry,and there are also a large number of irregular construction labor construction enterprises in the development.As an important participant in the field of engineering construction,according to the regulations,the general contractor must establish and improve the labor subcontracting system,improve the popularity of the real name system of the project labor team,so as to ensure the full payment of migrant workers'wages and avoid the corresponding legal consequences.
