“一带一路”背景下涉外律师发展问题研究

Study on the Development of Foreign Lawyers under the Background of"the Belt and Road Initiative"

“一带一路”开启了经济全球化的新时代。随着国家“一带一路”建设的深入推进,越来越多的中国企业走出国门,在境外投资创业、开拓市场,既给我国带来了机遇,也带来了挑战。企业在境外投资过程中所面临的法律风险与摩擦纠纷也日益增多。法治是“一带一路”建设的重要保障,律师是法治建设的重要力量。沿线国家法律背景复杂,法制水平参差不齐,而我国涉外法律人才奇缺,使得“一带一路”倡议推进有一定的困难,无法为境外投资提供有效的法律保护,基于现实需求,涉外法律人才的培养迫在眉睫。本文在“一带一路”背景下,论述我国现在面临的巨大挑战,以及现在涉外律师的现状,认为我们急需构建涉外法律人才培养的长期规划,提出我国律师业应对“一带一路”倡议的可行性对策。

The"Belt and Road Initiative"has opened up a new era of economic globalization.As China's"one belt,one road"construction is further promoted,more and more Chinese enterprises go abroad to invest and start businesses and expand their markets overseas.This brings both opportunities and challenges to our country.In the process of overseas investment,enterprises are facing more and more legal risks and friction disputes."The Belt and Road Initiative",one important guarantee for the construction of the rule of law,is the rule of law.One belt,one road,is imminent,which makes it difficult to promote the strategy of"one belt and one road",and can not provide effective legal protection for overseas investment.Based on actual needs,the cultivation of foreign legal talents is uneven.The present challenges facing China and the current situation of lawyers abroad are also discussed.We believe that we need to build long-term plans for training foreign legal professionals.
