摘要
后脱贫时代要实现脱贫攻坚与乡村振兴的衔接,生态补偿的减贫作用与发展促进作用必须同步彰显,构建生态补偿立法体系对此具有制度指引作用。面对当前生态补偿零散立法中存在的概念表述不一、理念存异、定位不准、功能局限与手段单一的问题,构建生态补偿立法体系要从保护激励、资源配置、手段多元与跨界补偿等方面入手,加强生态补偿立法专门化、定位生态化、手段市场化、功能综合化和规制整体化。
In the post-poverty era,in order to achieve the connection between poverty alleviation and rural revitalization,the role of ecological compensation in poverty alleviation and development promotion must be highlighted simultaneously.The construction of ecological compensation legislation system is of institutional guidance.Faced with the problems of different concept expressions,different ideas,inaccurate positioning,functional limitations and single means in the current scattered legislation of ecological compensation,the construction of an ecological compensation legislation system should strengthen incentive protection,resource allocation,means diversification and cross-border compensation to achieve the specialization of ecological compensation legislation,positioning ecologicalization,means marketization,integration of functions and regulations.
