风险社会视域下货车超载治理机制研究

The Study on the Governance Mechanism of Truck Overload from the Perspective of Risk Society

在风险社会背景下,新型风险治理是人们必须面对的课题。而货车超载这一新型风险不但增加社会成本,而且对社会公共安全造成极大威胁。目前,我国尚缺乏对货车超载的有效治理方法。从我国公共安全治理模式风险、市场自身风险以及监管体制风险等角度分析货车超载成为行业常态的原因,并从加强相关刑事立法、营造良好的市场环境以及合理运用综合治超行政手段等方面提出建议,以期为破解货车超载治理难题提供参考和借鉴。

Under the background of risk society,new risk management is the subject we must face.The new risk of overloading truck not only increases the social cost,but also poses a great threat to the public safety.At present,our country still lacks the effective management method to the truck overload.This paper analyzes the reasons why overloading truck becomes the norm from the perspectives like the risk of our public safety governance model,the risk of market itself and the risk of supervision system,and puts forward some suggestions from the aspects of strengthening relevant criminal legislation,creating a good market environment and using legal comprehensive administrative means to control truck overload,in order to provide references and lessons for solving difficult problems about the governance of truck overload.
