摘要
《關於内地與香港特別行政區法院就仲裁程序相互協助保全的安排》(簡稱《仲裁保全安排》)已於2019年10月1日正式生效。根據該安排,香港仲裁當事人可以向内地法院申請保全,保障裁決在内地的執行。本文將基於《仲裁保全安排》相關規定,結合目前司法實踐中做法,简述香港仲裁當事人向内地法院申請保全的措施、要求、程序及相關注意事项等,為香港當事人及律师申請保全提供系統、全面的操作指引。
The Arrangement Concerning Mutual Assistance in Courtordered Irterim Measures in Aid of Arbitral Proceedings by the Courts of the Mainland&of the Hong Kong Special Administrative Region(referred to as the"Arbitral Preservation Arrangement")has come into force since October 1,2019.The"Arbitral Preservation Arrangement" enables parties to a Hong Kong-seated arbitration to seck interim measurcs bcforc Mainland courts,so as to safeguard the subsequent enforcement of an arbitral award.
