环境资源法视域下突发性水污染事故追责体系构建研究

Establishment of Accountability System for Sudden Water Pollution Accidents from Perspective of Environmental and Resource Law

为了降低突发性水污染事故的发生概率,解决当前水污染事故管理中立法定位低、定刑标准模糊等问题,在环境资源法的支持下,构建突发性水污染事故追责体系。根据实际发生的突发性水污染事故,判断其事故级别。通过追溯突发性水污染事故成因,分别从直接责任人、社会责任主体和国家责任主体三个方面,确定事故责任构成。在现有环境资源法的基础上,完善法律的执行规范。在环境资源法及其相关条款视域下,从刑事、民事、行政等方面划分事故类型,并追究相应的事故责任。

In order to reduce the probability of sudden water pollution accidents and solve the problems of low legislative position and vague sentencing standard in current water pollution accident management,a system of accountability for sudden water pollution accidents is established with the support of the environmental and resource law.According to the actual sudden water pollution accident,the study judges its accident level.By tracing the causes of sudden water pollution accidents,the composition of accident liability is determined from three aspects:the person directly responsible,the subject of social responsibility and the subject of state responsibility.On the basis of the existing environmental and resources law,it improves the implementation of the law.From the perspective of the environmental and resource law and its related provisions,the types of accidents are classified from criminal,civil and administrative aspects,and the corresponding liabilities are investigated.
