人类正在步入一个由互联网、大数据和人工智能三重叠加的数字社会,大数据已然成为社会发展的新要素、新动力、新战略,正在以前所未有的速度、广度、深度影响社会秩序。大数据在便捷、高效地推动社会进步的同时也存在着数据失序等问题,给社会秩序造成一定冲击,也对社会治理提出了严峻挑战。数据作为当下和未来一种关键的战略资源,从本质上来说这种战略资源便是数权,对数权体系的构建和对数权冲突的化解是有效数据治理的关键,是社会治理现代化的基础。解构数权的私权利和公权力,平衡两者的矛盾冲突,适当让渡数据私权,同时加强对数据公权的规范,消除数据壁垒,促进数据流通与共享,才能构建数字化发展良好的生态环境,提高社会治理能力与水平。

Human beings are stepping into a digital society which is composed of Internet,big data and artificial intelligence.Big data has become a new element,driving force and strategy of social development,and is affecting social order at an unprecedented speed,breadth and depth.Big data promotes social progress in a convenient and efficient way,but at the same time,there are also problems such as data disorder,which has a certain impact on social order,and also poses a serious challenge to social governance.As a key strategic resource for the present and future,data is essentially the data right.The key to effective data governance is the construction of the system of data rights and the resolution of the conflict of data rights,which is the foundation of the modernization of social governance.Only by deconstructing the private rights and public powers of data rights,balancing the contradictions and conflicts between them,appropriately transferring the private rights of data,at the same time,we should strengthen the standard of data public right,eliminating data barriers and promoting data circulation and sharing,can we build a good ecological environment for digital development and improve the ability and level of social governance.
