国际法中“权威学说”功能的流变与当下意义

摘要 “权威学说”是明文规定于《国际法院规约》第38条的法律概念,其在国际法中的功能由早期的直接国际法渊源逐步演化为辅助渊源。这一流变具有“权威学说”本身的缺陷和国际法整体的发展两个方面的原因。近年来,以《塔林手册》为代表的新型“权威学说”在国际法实践中呈现出新的活力。与此同时,“权威学说”是当前国际法学者沟通理论与实践的重要桥梁。我国应当重视“权威学说”在加强国际法律事务话语权中的作用,推动构建国际法的中国理论。 The“Most Highly Qualified Teachings”is a legal concept in article 38 of the Statute of the International Court of Justice,which gradually turned into subsidiary means for the determination of rules of international law.Such a transition is rooted in its inherent weakness and the development of international law.Recently,a new kind of“Most Highly Qualified Teachings”,represented by the“Tallinn Manual”,has revived in the practice of international law.Meanwhile,the“Most Highly Qualified Teachings”act as an important bridge aligning the theory and practice of international law.China should attach due importance to the role of the“Most Highly Qualified Teachings”in strengthening the discourse of international legal affairs and promote the construction of Chinese theory of international law.
