网络时代的民用航空犯罪及刑法应对

Civil Aviation Crime and Corresponding Criminal Law Countermeasures in the Network Era

网络犯罪可以分为针对网络犯罪、利用网络犯罪和在网络空间犯罪,这三种类型的网络犯罪都可能会危害民航运输安全。利用网络散布谣言危害航空安全的,如果造成现实世界中的公共秩序混乱,可以以寻衅滋事罪论处,如果仅仅造成网络空间里的混乱则可以故意编造、传播虚假信息罪论处。明知他人要实施危害民航的犯罪而提供网络技术支持的可以按照帮助信息网络犯罪活动罪或以共同犯罪论处,不能以中立帮助行为进行辩解。

Cybercrime can be divided into the crime aiming at network,the crime by using network and the crime in cyberspace.All these three types of cybercrime could endanger civil aviation transportation.For those actions of using the internet to spread rumors that have threaten the safety of aviation,if they have caused public disorder in the real world,they can be identified as Defiance and Affray;it they have only led to the chaos in cyberspace,they can be identified as the crime of deliberately fabricating and spreading false information.Those who still provide network technologies for others after knowing that they are committing crimes to harm aviation can be identified as aiding cybercrime or a joint crime.They cannot be defended by the reason of taking a neutral helping behavior.
