摘要
2019年12月25日,最高人民法院发布了《关于修改〈关于民事诉讼证据的若干规定〉的决定》,对于完善民事诉讼鉴定制度具有重要意义。本文梳理了民诉法有关鉴定规定的变化,对新《民事诉讼证据规定》有关鉴定问题进行了重点分析,提出了进一步完善民事诉讼鉴定制度的具体建议。
On December 25,2019,the Supreme People’s Court issued the“Decision of the Supreme People’s Court to Amend the Provisions on Evidence in Civil Procedure”,which is of great significance to improve the system of expert testimony of civil litigation.This paper sorts out the changes of the expert testimony regulations in the civil litigation law,analyzes the relevant regulations of the expert testimony of“the Provisions on Evidence in Civil Procedure”,and puts forward specific suggestions to refine expert testimony system in the civil litigation.
