论中国共产党历史上的法治思维——以新民主主义革命时期为例

On the Legal Thinking in the History of the Communist Party of China:Based on the History of New Democratic Revolution

法治思维是中国共产党在21世纪面向全党正式提出的治国理政思维,是中国共产党人百年成功经验的总结,深深扎根于中国共产党人的百年奋斗史。从中国共产党的历史看,凡是比较重视法治思维的阶段,都是中国共产党领导人民进行各项事业取得更大成绩的阶段;反之,则要付出惨痛的代价。因此,我们要站在更加深邃的历史维度,更加牢固地坚持法治思维,全方位地坚持运用法治思维开展各项工作。

Governance through the legal thinking is the strategy proposed by the Communist Party of China in the 21 st century. However, this strategy is not a new one, but deeply rooted in the history of the revolution, construction and reform that the Communist Party of China has led the people through for the last century. From the perspective of the history of the Communist Party of China, when the party attached importance to the legal thinking, the party would made greater achievements in work. When the party ignored the legal thinking, the party would make mistakes. Therefore, we should regard the strategy of governance through the legal thinking as a summary of the CPC’s experience over the past one hundred years.
