Application of Laws Concerning Biogenetic Resources Beyond National Jurisdiction

由于存在巨大科研与经济价值,国家管辖范围外的海洋生物遗传资源一直是国际社会关注的焦点。2015年,联合国大会决议制定了一项具有法律约束力的文书,以规范国家管辖范围外的海洋生物多样性问题。但至今为止,围绕国家管辖范围外生物遗传资源的法律地位与适用机制问题的争议不断。现阶段,国际社会应当选择更加务实的解决路径,以积极应对国家管辖范围外生物遗传资源领域相关问题。

Due to their great scientific research and economic value,the marine biogenetic resources in areas beyond national jurisdiction (ABNJ) have always been the focus of attention in the international community.In 2015,the General Assembly of the United Nations adopted a legally binding instrument to regulate marine biodiversity in ABNJ.But up to now,there are still many disputes about the legal status of and application mechanism for biogenetic resources in ABNJ.At this moment,the international community should take a more pragmatic path to actively respond to the relevant issues in the field of biogenetic resources in ABNJ.
