The Dilemma of and Solution to the Non-litigation Administrative Compulsory Execution

现行司法体制改革的目标是优化司法职权配置。妥善解决执行难的问题是深化司法体制改革的重要内容,而非诉行政强制执行的执行难尤为突出。裁执分离模式作为司法权与行政权重新配置和功能优化的有益探索,尝试使得司法回归裁判权,行政重获执行权,保障司法权的公正独立与行政权的高效,提高非诉行政强执行力,完善和健全现有司法权力运行机制。

The goal of the current reform of the judicial system is to optimize the allocation of judicial authorities.Addressing the difficulties in execution of court decisions,especially those on non-litigation administrative cases,is an important part of our efforts to deepen reform of the judicial system.This article proposes introducing the adjudication-enforcement separation as a beneficial exploration for reallocating the judicial and administrative powers and optimizing their functions;trying to make the judiciary return to the judicial power and the government regain the executive power;ensuring the impartiality and independence of the judicial power and the efficiency of the administrative power;strengthening compulsory execution related to the non-litigation administrative cases;and improving the existing operation mechanism of the judicial power.
