违法性认识的本土化探究

A Probe into the Localization of Illegal Cognition

随着法定犯比重的日益上升,违法性认识理论也愈发成为刑法中的一个关键问题。本文通过文献阅读和案例研究的方式,试图对违法性认识在我国的立足作出初步探索。在理论运用方面,主要根植于违法性认识与社会危害性的关系这一极具中国特色的话题,认为二者的分离是建立在彼此认识内容相异的前提下,而社会危害性在认定犯罪方面有着不可磨灭的作用,违法性认识则可作为刑事责任承担的考察因素。

With the increasing proportion of legal offenders, the theory of illegal cognition has become a key issue in criminal law. This article attempts to make a preliminary exploration of the foundation of illegal knowledge in my country through literature reading and case studies. In the application of theory, it is mainly rooted in the topic of Chinese characteristics, which is the relationship between illegal cognition and social harmfulness. The aspect has an indelible effect, and the awareness of illegality can be used as an investigation factor for criminal responsibility.
