“一台子戏”的著作权法保护秩序重构

摘要 "一台子戏"涉及戏剧作品、舞蹈作品、音乐作品、美术作品、表演者的著作权保护,较为复杂。从比较法角度来看,戏剧作品或规定为文字作品,或单独例示,但均认可其"供演出"属性;舞蹈作品和哑剧的规定方式有区别,但均并列例示。为构建"一台子戏"著作权法正义的保护秩序,应将戏剧作品保护对象明确为剧本,增加哑剧的例示;应撇除音乐作品的重叠,避免规避法定许可而扩大著作权范围;应利用美术作品和表演者权为相关的创作者和表演者提供著作权和邻接权保护。 "One Stage of Drama" involves the copyright protection of dramatic works, choreographic works, musical works, art works and performers, which is relatively complicated. From the perspective of comparative law, dramatic works are either written works or separately exemplified, but their attributes of "for performance" are recognized,the prescribed ways of choreographic works and pantomime are different, but they are all illustrated side by side. In order to construct the just copyright law protection order of of "One Stage of Drama", the protection object of dramatic works should be defined as plays and the examples of pantomime should be increased, the overlap of musical works should be put aside to avoid evading compulsory liscence and expanding the scope of copyright,and should be used to provide copyright and neighboring rights protection for relevant creators of art works and performers.
