摘要
大学章程是法治化、现代化的制度保障,它的功能定位决定了其能够在多大程度上解决高校治理的效度和力度,以适应高校新时代发展的客观需求。面对大学章程同质化现象,“依章程而治”的现代大学制度一定不能仅仅停留于形式层面,必须从凝聚价值共识、提升制度效能出发,建构有利于实现立德树人基本任务的高校治理机制,营造尊重学术规律的知识创新环境,形成校内职能部门合理分工、相互协调的法治思维。
The university by-laws is the institutional guarantee of the rule of law and modernizaiton in higher education.The function of universities by-laws determines the extent of validity and strength of university governance,so as to meet the needs of new era.In face of the universities by-laws homogeneity,“rule of the university by-laws”can not stay in the form.In order to enhance the efficiency of the university by-laws,it is necessary to facilitate the governance mechanism which is suitable of achieving morality,create environment that respects academic,and implement the rule of law while dividing university departments.
