摘要
职业安全卫生问题直接涉及劳动者的生命与健康。目前我国劳动法领域对劳动者的职业安全卫生权利作出了相应的规定,但与国际劳工组织的《职业安全卫生公约》相比,在遵循国家政策、三方(政府、雇主、劳动者)的职责等方面存在融合之处,在构建职业安全卫生法律制度的理念、相关法律的适用范围及职业安全卫生监管体制方面存在一定的差距。我们应借鉴国际劳工立法经验,从贯彻"以人为本"的立法理念、规范职业安全卫生法律的适用范围及整合职业安全卫生监管机制三个方面来完善职业安全卫生法律制度。
Occupational safety and health issues directly involve the life and health of workers. At present, China ’s labor law has made corresponding regulations on the occupational safety and health rights of workers. Compared with theInternational Labour Organization ’s Occupational Safety and Health Convention, it follows the national policies and the responsibilities of the three parties(government, employers, workers), etc. In terms of integration, there is a critical gap in the construction of the concept of the occupational safety and health legal system, the scope of application of relevant laws, and the occupational safety and health supervision system. Therefore, drawing on the experience of international labor legislation, we will improve China’s occupational safety and health legal system by implementing the"people-oriented"legislative concept, standardizing the scope of occupational safety and health laws and integrating the occupational safety and health supervision mechanism.
